Gum Fork Man Wounded In Shoot-Out Dies Monday In Knoxville Hospital

A Winfield man is dead and a retired Navy Lieutenant Commander who came back home at his retirement has been charged with murder in a shoot-out on a narrow country road Friday afternoon.

Dead is Eldred Anderson, 47, of Gum Fork community, and charge in the shooting is D. L. (Lindenburg) Cecil of Jellico Creek community, who was also wounded. Anderson died about Midnight Monday in Fort Sanders from bullet wounds in the lower stomach and upper chest. He had been transferred to the Knoxville hospital from Scott County Hospital where he was taken by his brother immediately after the shooting. Billy Anderson, brother of the dead man, was a witness to the shooting. Also at the scene were several youngsters on a school bus, including four of Cecil's children. The shooting occurred about 4:15 p.m. Friday, within about 300 yards of Cecil's home, which is located on a large farm. The farm is located about 17 miles northeast of Oneida. A portion of the farm formerly belonged to the present owner's family. Sheriff Julius Lewallen said that he learned from investigation that the shooting occurred in the following manner.

Cecil, on a tractor, and Billy Anderson, in a car had met in the road and parked on each side of the road to talk about a hog that had been in their corn. While they were trying to determine the owner of the hog, the school bus arrived. They were moving their vehicles further to the side of the road to allow room for the bus to pass through, when Eldred Anderson drove up behind the bus in his truck.

Eldred Anderson apparently became impatient and got out of his truck. At this point the shooting began. Cecil rolled off the tractor as the first shot was fired. A bullet went through the tractor seat where he had been sitting. Apparently both men emptied their guns. Anderson was struck at least three times, and Cecil at least once, in the leg. A bullet also struck the front bumper of the bus, which contained 10 children. Hoyle (Red) Crabtree, of Winfield, was the driver of the bus.

Cecil went to his home following the shooting and phoned the Sheriff's Department at Huntsville and reported the trouble. He reported to Sheriff Lewallen that he (Cecil) had also been wounded in the shooting and the sheriff told him to report to the hospital where he would meet him. Eldred Anderson had already been taken to the hospital. The two men involved in the shooting were acquainted. According to reports there had been some disagreement between the two. However, there apparently was no trouble between Billy Anderson and Cecil, at the time the shooting occurred.

Cecil's hearing on the charge is set for Oct. 30 in Session Court at Huntsville, at 9 a.m. before Judge Charles Sexton. Cecil is free on $10,000 bond.

Eldred Anderson formerly had been employed by General Motors. Cecil had retired from the Navy and returned to Scott County several years ago. About five years ago he bought the farm where he now resides.

Funeral services for the victim will be held today (Thursday) at 2 p.m. at Gum Fork Baptist Church, Winfield, Rev. Raymond Brown officiating. Burial will be in the Church Cemetery.

Survivors include his wife, Loraine; a daughter, Angela Gadberry, Russell Springs, Ky.; four other brothers, besides Billy, Willis and Raymond, Winfield, Drayton, Columbus, Ohio; Ronald, Independence, Ky.; and three sisters, Ruth Gariat, Franklin, Ohio, Pauline Long, Columbus, Ohio, and Ann Longmira, also of Columbus, Ohio. Also surviving is his step mother, Katherine Anderson. He was a son of Arthur Anderson and Eva Childers, both deceased. (Source: The Scott County News, 17 Oct 1974, p1-2)
